Statement of purpose:  This bill proposes to determine which employers have a significant number of employees who receive health insurance through the Vermont health access plan.

AN ACT RELATING TO NONAFFORDABILITY OF EMPLOYER‑SPONSORED HEALTH INSURANCE

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  STUDY

(a)  The office of Vermont health access shall conduct a study to determine which employers employ individuals or their dependents who receive coverage through the Vermont health access plan (VHAP) or Dr. Dynasaur.  The study shall include which employers have employees receiving health insurance coverage through VHAP or Dr. Dynasaur, whether the employer offers health insurance coverage, the premium and other cost-sharing of such insurance to the employee, the cost of the insurance to the employer, and any practices of the employer which encourage employees to apply for VHAP.

(b)  The director of the office of Vermont health access shall report on January 15 of the first year of each biennium to the house and senate committees on health and welfare as to the employers employing public health program beneficiaries.  The report shall include the total number of employed Vermonters and their dependents covered by VHAP or Dr. Dynasaur; the name and location of each employer with employees or their dependents enrolled in VHAP or Dr. Dynasaur; the number of employees or their dependents enrolled in VHAP or Dr. Dynasaur listed by employer; and information as to the cost of the employer-sponsored insurance offered by these employers, if any.  The office shall not include any information identifying an individual beneficiary and shall comply with the Health Insurance Portability and Accountability Act of 1996.

Sec. 2.  33 V.S.A. § 1973 is amended to read:

§ 1973.  VERMONT HEALTH ACCESS PLAN

(a)  The department of prevention, assistance, transition, and health access agency of human services shall establish the Vermont health access plan (VHAP) pursuant to a waiver of federal Medicaid law.  The plan shall remain in effect as long as the federal waiver is granted or renewed.

(b)  The purpose of the Vermont health access plan is to provide health care coverage for uninsured or underinsured low income Vermonters.  The commissioner of the department of prevention, assistance, transition, and health access secretary of human services shall establish rules regarding eligibility and administration of the plan.

(c)  The office of Vermont health access shall request applicants to furnish the name, address, and telephone number of the individual’s employer for statistical purposes.  Failure to provide information needed only for statistical purposes shall not affect an individual’s eligibility for the program.
