Subject: Municipal government; powers; aerial spraying
Statement of purpose: This bill proposes to authorize a municipality to prohibit or otherwise regulate aerial spraying of economic poisons onto utility pole rights-of-way within the municipality.
AN ACT RELATING TO MUNICIPAL AUTHORITY TO PROHIBIT AERIAL SPRAYING OF ECONOMIC POISONS
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 24 V.S.A. § 2291 is amended to read:
§ 2291. ENUMERATION OF POWERS
For the purpose of promoting the public health, safety, welfare, and convenience, a town, city, or incorporated village shall have the following powers:

(6) To regulate the location, installation, maintenance, repair, and removal of utility poles, wires, and conduits, water pipes or mains, gas mains and sewers, upon, under, or above public highways or public property of the municipality and, notwithstanding any provision of 6 V.S.A. § 1103 to the contrary, to prohibit or otherwise regulate application of an economic poison, as defined by 6 V.S.A. § 911, used to maintain the rights-of-way for utility poles and wires located within the municipality or specified portions of the municipality.
