Subject: Municipal government; secession
Statement of purpose: This bill proposes to sever all connections with, and support for, a municipality which secedes from the state.
AN ACT RELATING TO ELIMINATING SUPPORT FOR A MUNICIPALITY WHICH SECEDES FROM THE STATE
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 24 V.S.A. § 1244 is added to read:
§ 1244. MUNICIPALITIES; SECESSION
(a) If a municipality secedes from the state, the following shall take effect immediately upon secession:
(1) The municipality shall thereafter receive from the state no monies in any form and for any purpose, including monies for:
(A) capital construction;
(2) All residents of the municipality shall be deemed nonresidents of the state and as such shall not be eligible for:
(A) a state driver’s license;
(B) a resident hunting or fishing license;
(C) any state service for which only residents of the state are eligible.
(3) All contracts, leases, and other agreements entered into between the municipality, or any business within the municipality, and the state shall terminate.
(4) The municipality shall be removed from inclusion in any travel promotional publication of any state agency.
(b) If a municipality secedes from the state, the secretary of administration, after holding two public hearings, shall establish exit fees for stranded assets of the state, including those relating to education, transportation, and public service.
