Subject:  Conservation; beverage containers; bottle bill

Statement of purpose:  This bill proposes to require redemption centers to accept any beverage container stamped as refundable in the state, regardless of whether the manufacturer or distributor of a particular container collects the containers from the redemption center.

AN ACT RELATING TO REQUIRING REDEMPTION CENTERS TO ACCEPT ALL BEVERAGE CONTAINERS WITH THE VERMONT STAMP

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  10 V.S.A. § 1523(a) is amended to read:

(a)  Except as provided in section 1522 of this title:

(1)  A retailer shall not refuse to accept from any person any empty beverage containers of the kind, size, and brand sold by the retailer, or refuse to pay to that person the refund value of a beverage container as established by section 1522 of this title, except as provided in subsection (b) of this section.

(2)  A manufacturer or distributor may not refuse to accept from a retailer or a person operating a redemption center any empty beverage containers of the kind, size, and brand sold by the manufacturer or distributor, or refuse to pay the retailer or a person operating a redemption center the refund value of a beverage container as established by section 1522 of this title.

(3)  A person operating a redemption center shall not refuse to accept from any person any empty beverage container that has been labeled under this chapter or refuse to pay to that person the refund value of that beverage container regardless of whether the manufacturer or distributor fails to collect the empty beverage containers from the redemption center.
