Subject:  Motor vehicles; point system; five points; drivers’ education  

Statement of purpose:  This bill proposes to require a licensed driver who has accumulated five points on his or her license within a two‑year period to pass a written and road test or have the license suspended.

AN ACT RELATING TO DRIVERS’ EDUCATION

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  23 V.S.A. § 2505 is amended to read:

§ 2505.  SUSPENSION OR REVOCATION OF LICENSE; DRIVERS’

              EDUCATION COURSE

When a person receives a number of convictions for moving violations sufficient to raise his point total to at least ten points for convictions of moving violations in a two-year period, the commissioner shall initiate suspension proceedings pursuant to section 2506 of this title.  However, upon receiving five points within a two‑year period, the offender shall have six months to be retested for a license, including the written and road test, and shall pass the test, or his or her license shall be suspended until the test is satisfactorily passed.
