Subject: Agriculture; agricultural land; conveyance of development rights
Statement of purpose: This bill proposes to limit to 20 years the validity of any development rights acquired in agricultural land involving the use of public monies.
AN ACT RELATING TO LIMITING FUTURE USE OF AGRICULTURAL LAND
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 27 V.S.A. § 310 is added to read:
§ 310. DURATION OF RESTRICTIONS ON FUTURE USE OF AGRICULTURAL LAND
When a conveyance of a parcel of agricultural real property purports to place a restriction on the future use of the property and the conveyance is financed to any extent with public funds, the restriction shall be void and unenforceable after a period of 20 years.
