Subject: Health; public health; phenylketonuria; treatment program
Statement of purpose: This bill proposes to ensure that Vermonters with phenylketonuria are able to access treatment within the state of Vermont.
AN ACT RELATING TO TREATMENT FOR PHENYLKETONURIA
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 18 V.S.A. Part 2, chapter 39 is added to read:
Chapter 39. Phenylketonuria Treatment Program
§ 1771. DEFINITIONS
As used in this chapter:
(1) “Health care facility” shall have the same meaning as in subdivision 9432(7) of this title.
(2) “Health care provider” shall have the same meaning as in subdivision 9432(8) of this title.
(3) “Phenylketonuria (PKU)” means an inherited disorder of body chemistry that, if untreated, causes mental retardation.
§ 1772. Phenylketonuria (PKU) Clinics
The commissioner of health shall establish one or more statewide PKU clinics in such parts of the state as the commissioner may deem most advantageous for the public health. In determining where to locate the clinics in order to ensure geographic access for Vermonters, the commissioner shall consider the out-of-state treatment sites. The commissioner may cooperate or contract with a health care facility or health care provider in establishing the clinics.
§ 1773. Contributions
The commissioner is authorized to receive voluntary contributions for the purposes of this chapter from any source in addition to any available state or federal funds.
