Subject: Fish and wildlife; use value appraisal program; posting
Statement of purpose: This bill proposes to stipulate that land posted against hunting and fishing shall not be eligible to participate in the use value appraisal program.
AN ACT RELATING TO PROHIBITING POSTING ON LAND ENROLLED IN THE USE VALUE APPRAISAL PROGRAM
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 32 V.S.A. § 3755(a) is amended to read:

subsection (b) subsections (b) and (f) of this
section, any agricultural land, managed forest land, and farm buildings
which meet the criteria contained in this subchapter and in the regulations
adopted by the board shall be eligible for use value appraisal.
Sec. 2. 32 V.S.A. § 3755(f) is added to read:
(f) Agricultural land and managed forest land shall not be eligible for use value appraisal if the land is posted against hunting and fishing under
10 V.S.A. § 5201. However, this provision shall not apply to a pasture in which livestock are held nor to a portion of the land in which it is necessary to prohibit hunting either for the safety of a person working on the land or for the safety of customers in a commercial enterprise.
