Subject: Conservation; Act 250; growth centers
Statement of purpose: This bill proposes to amend Act 250 by requiring a district commission to waive criterion 8(A) as it applies to the habitat of significant large wildlife, criterion 9(A), relating to primary agricultural soils, and criterion 9(B), relating to secondary agricultural soils, when the project applied for is within a growth center, within a circumferential highway, within a city bypass highway, or near a municipal airport. The bill proposes to define growth centers: as being designated by act of the municipal legislative body; as normally offering community services such as water supply, sewer service, and natural gas, if applicable; and as being zoned for mixed uses, including commercial and industrial uses, residential units of less than one acre each, multifamily units, condominiums, and apartments.
