Statement of purpose:  This bill proposes to allow state and local governments, when required to accept the lowest bid for a contract, to accept a local contractor whose bid exceeds by up to 10 percent the lowest bid.

AN ACT RELATING TO STATE AND MUNICIPAL ACCEPTANCE OF LOCAL CONTRACTOR BIDS

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  3 V.S.A. § 2255 is added to read:

§ 2255.  CONTRACTS ENTERED INTO BY STATE OR MUNICIPAL

GOVERNMENT

Notwithstanding any provision of law to the contrary, the state or a municipality, when required by law to accept the lowest bid for a contract, may accept the bid of a local contractor which exceeds by up to 10 percent the lowest bid.  For the purposes of this section, the head of a state agency or legislative body of a municipality shall have the discretion to determine what entity constitutes a “local contractor.”
