Subject:  Crimes; accessory after the fact; relatives

Statement of purpose:  This bill proposes to permit parents, spouses, and other relatives to be charged with the crime of being an accessory after the fact.

AN ACT RELATING TO PERMITTING PARENTS, SPOUSES, AND OTHER RELATIVES TO BE CHARGED WITH BEING AN ACCESSORY AFTER THE FACT

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  13 V.S.A. § 5 is amended to read:

§ 5.  ACCESSORY AFTER THE FACT

A person not standing in the relation of husband, wife, parent, grandparent, child, grandchild, brother or sister, by consanguinity or affinity, to an offender, who, after the commission of a felony, harbors, conceals, maintains, or assists such an offender with intent that he or she shall avoid or escape arrest or punishment therefor, shall be imprisoned not more than seven years or fined not more than $1,000.00, or both.
