Statement of purpose: This bill proposes to allow agricultural tourism enterprises to use portable toilets for wastewater needs between May 15 and November 15.
AN ACT RELATING TO AN AGRICULTURAL TOURISM EXEMPTION TO WASTEWATER SYSTEM REQUIREMENTS
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 10 V.S.A. § 1972(11) is added to read:
(11) “Agricultural tourism enterprise” is a farm, orchard, or other agricultural operation that:
(A) is open to the public;
(B) is located on agricultural land as that term is defined in section 3752 of Title 32; and
(C) offers educational activity, entertainment, recreational activity, direct sales, or participation in the daily activities of a farm, orchard, or agricultural operation.
Sec. 2. 10 V.S.A. § 1973(j) is added to read:
(j) An agricultural tourism enterprise may use portable toilets to serve employees and patrons between May 15 and November 15 if the portable toilets meet the design requirements set by the agency by rule and are serviced weekly by a licensed waste hauler.
