Statement of purpose: This bill proposes to amend the Act 250 exemption of land located below 2,500 feet that is used for farming, so that the land is exempt whether it is owned or leased by the farmer.
AN ACT RELATING TO AN ACT 250 EXEMPTION FOR LEASED LAND THAT IS THE SITE OF FARMING
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 10 V.S.A. § 6001(3)(D) is amended to read:
(D) The word “development” does not include:
construction of improvements below the elevation of 2,500 feet for
farming, whether on land owned or leased by the farmer, or for logging
or forestry purposes
below the elevation of 2,500 feet.
