Subject:  Public service; performance-based rates

Statement of purpose:  This bill proposes to make it state policy that the profitability of a regulated utility shall not be linked to sales of product, but shall be determined by the performance of the utility company in attaining system efficiency; in providing cost-effective, high quality service; and in operating in compliance with state energy policy.

AN ACT RELATING TO PERFORMANCE-BASED UTILITY RATEMAKING

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  30 V.S.A. § 225(d) is added to read:

(d)  It is a policy of the state to implement the regulatory system established under this title so that the profitability of a regulated company shall not be linked to sales of the product, but shall be determined by the performance of the company in attaining system efficiency; in providing cost-effective, high quality service; and in operating in compliance with state energy policy as established in this chapter.  The public service board shall take appropriate measures to implement this policy over an appropriate period of time.
