AN ACT RELATING TO MILITARY SERVICE AND PROFESSIONAL REGULATION
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 20 V.S.A. § 1547 is added to read:
§ 1547. SERVICE ON ACTIVE DUTY; PROFESSIONS AND
OCCUPATIONS; STATE REGULATION
Notwithstanding any provision of law to the contrary, a person whose profession or occupation is regulated by an agency of the state and who at the time of service on active duty, as defined in 38 U.S.C. § 101(21), in the United States military holds a valid license or certification to practice that profession or occupation shall be entitled to the following:
(1) The period for which the person holds the license or certification shall cease to run for the period of service on active duty.
(2) If service on active duty in any way interferes with a good faith effort to complete a term or condition of licensure or certification or of renewal of licensure or certification, the agency that regulates the profession or occupation shall provide the person with a reasonable opportunity to meet the term or condition following the person’s return from service on active duty.
Sec. 2. EFFECTIVE DATE
This act shall take effect upon passage and shall apply retroactively to any person who meets the requirements of 20 V.S.A. § 1547 and who began active duty in the United States military on July 1, 2005 or thereafter.
