AN ACT RELATING TO ISSUING CERTIFICATES OF PUBLIC GOOD TO MERCHANT ELECTRIC PLANTS
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 30 V.S.A. § 248(m) is added to read:
(m) In any proceeding under subdivision (a)(2)(A) of this section, a demonstration of compliance with subdivision (b)(2) of this section relating to establishing need for the facility, shall not be required if the facility is a merchant plant and if no part of the facility is financed directly or indirectly through investments, other than power contracts, backed by Vermont electricity ratepayers. As used in this subsection, “merchant plant” means an electric generation facility and its associated interconnection facilities whose marketed electrical energy shall be sold in competitive markets.
