NO. M-2.  AN ACT RELATING TO THE MIDDLETOWN SPRINGS, IRA, POULTNEY, TINMOUTH, AND WELLS TOWN LINES.

(H.93)

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  LEGISLATIVE FINDINGS AND PURPOSE

(a)  The general assembly finds that it is vested with the authority to establish town lines under Chapter II, § 6 of the Constitution of the State of Vermont.

(b)  The towns of Middletown Springs, Ira, Poultney, Tinmouth, and Wells, acting by and through the selectboards of each town, have petitioned the general assembly for establishment of the boundary lines among them.

(c)  The petitioning towns request that the boundary lines be established according to a survey conducted by registered land surveyor Nicholas P. Nowlan on January 22, 2002 and revised on March 9, 2004, which was stipulated to by the selectboards of the respective towns on March 23, 2004 and which was approved by presiding judge Richard Walsh Norton in Rutland Superior Court (In Re:  Boundary of Middletown Springs; Docket No. S318‑5‑03Rdcv).

Sec. 2.  MIDDLETOWN SPRINGS, IRA, POULTNEY, TINMOUTH, AND

             WELLS TOWN LINES

Notwithstanding the provisions of section 17 of Title 2, the general assembly hereby declares and establishes the boundaries among the towns of Middletown Springs, Ira, Poultney, Tinmouth, and Wells to be those set forth in the survey conducted by registered land surveyor Nicholas P. Nowlan on January 22, 2002 and revised on March 9, 2004, which was stipulated to by the selectboards of the respective towns on March 23, 2004 and which was approved by presiding judge Richard Walsh Norton in Rutland Superior Court (In Re:  Boundary of Middletown Springs; Docket No. S318‑5‑03Rdcv).

Sec. 3.  SUPPORTING DOCUMENTATION

Upon passage of this act, copies of the documents supporting the mutual agreement shall be filed in the office of the secretary of state.

Sec. 4.  EFFECTIVE DATE

This act shall take effect from passage and shall apply retroactively to April 1, 2005.
