Prescription drugs; substance abuse; pharmacists; law enforcement
This act authorizes the department of health, if it obtains sufficient funding, to establish an electronic database and reporting system for prescriptions of Schedules II, III, and IV controlled substances. Pursuant to the system, pharmacists would be required to report electronically a patient identifier which may be the patient's name, the drug dispensed the quantity dispensed, and the prescribing health care provider. Data in the system are exempt from the public records law. The department may only disclose system data in specified circumstances and to specified persons, which include a patient or the patient's provider, a provider seeking information for the purpose of providing health care, or a professional licensing board. Data may be disclosed to the commissioner of public safety to avert a serious and imminent threat to a person or the public. Criminal penalties attach for knowing disclosure or receipt of information in violation of the act. Pharmacists and providers are immune from civil, criminal, and administrative liability for good faith compliance. An advisory committee shall be formed to assist in the implementation and periodic evaluation of the system.
