ACT NO. 171


Universal telecommunications service

This act provides several clarifying amendments to the statutes relating to the universal telecommunications service and the fund for its support.

The first section makes clear that the fiscal agent for the fund acts as a fiduciary for the ratepayers until the funds have been paid out. Section 2 amends the statute to allow the Public Service Board to establish an annual rate of charge without opening a docket and extends the time for the general assembly to enact an authorization amount for E-911 from May to July 15. Section 3 authorizes the initiation of civil suits to collect payments, interest, and penalties on behalf of the state or fiscal agent. The last section, section 4, allows the Department of Public Service to contract with vendors to provide equipment for the telecommunications relay service program providing the most favorable proposal without requiring the approval of the Public Service Board.
