Cancer drugs; off-label use; licensing of wholesaler
drug distributors; electronic pedigree study; drug repository study
This act requires health insurance plans that provide coverage for prescription drugs to provide coverage for the off-label use of drugs, provided the use is a medically accepted indication for the treatment of cancer. A health benefit plan that denies an off-label use shall treat any internal appeal as an emergency or urgent appeal. This act also authorizes the board of pharmacy to adopt licensing rules applicable to wholesale drug distributors; and to study the feasibility of any electronic pedigree system that would verify the chain of distribution for all prescription drugs and report its findings and recommendations to the general assembly not later than January 15, 2007. Finally, the act requires the department of health to lead a study of the feasibility of creating a drug and medical supply repository program and report its findings and recommendations to the general assembly not later than January 15, 2007.
