SUMMARY OF THE 2006 ACTS AND RESOLVES

Solid waste; environmental contingency fund;

waste management assistance fund

This act authorizes the secretary of natural resources to allocate funds at the end of each fiscal year from the solid waste management assistance account of the waste management assistance fund to the environmental contingency fund upon a determination that the funds available in the environmental contingency fund are insufficient to meet the state's obligations to pay the costs of required capital contributions and maintenance for remedial or response actions taken under the federal Comprehensive Environmental Response, Compensation, and Liability Act. The act would repeal the authority of the secretary of natural resources to transfer funds from the solid waste management account to the environmental contingency fund on January 16, 2011. The act also requires the secretary of natural resources to annually allocate 17% of the receipts in the solid waste management assistance account of the waste management assistance fund for implementation of the statewide waste management plan and municipal solid waste management plans. In addition, the act authorizes landfills operating prior to December 31, 1979 to receive disbursements from the solid waste management assistance account of the waste management assistance fund. The act requires the secretary of natural resources to adopt by procedure technical and financial criteria for disbursements to landfills from the solid waste management assistance account. The act also requires the secretary of natural resources to include a recommendation of potential funding mechanisms for the environmental contingency fund in the statutorily required report on the fund.
