ACT NO. 111

Court procedure; restrictions; eminent domain

This act prohibits any governmental or private entity from taking private property through the use of eminent domain if the taking is primarily for purposes of economic development, unless the property is taken pursuant to chapter 85 of Title 24 (urban renewal). In determining whether a property may be taken by eminent domain for purposes of urban renewal, the act prevents an area from being designated as blighted solely or primarily because the property's condition and value for tax purposes are less than the condition and value projected as the result of the implementation of any state, municipal, or private redevelopment plan. Similarly, in the necessity hearing the court is directed to not give weight to a projected increase in economic value of the subject property solely or primarily because its condition and value for tax purposes are less than the condition and value projected as the result of the implementation of any state, municipal, or private redevelopment plan.
