ACT NO. 35
Commerce and trade; consumer fraud; predatory pricing
This act prohibits a person from pricing goods or services in a manner that tends to create or maintain a monopoly or otherwise harms competition, if the intent of the pricing was to harm competition. A violation is deemed to be an unfair method of competition in commerce, and the same remedies available under current law shall apply, including assurances of discontinuance and civil injunctions. In addition, a person aggrieved by a violation of this act or a violation of rules adopted under this act may bring an action in superior court for appropriate relief.
