ACT NO. 29

School buses; multifunction school activity bus; motor coaches

This act exempts, in the motor vehicle statutes, the following two vehicles from the definition of a school bus:

1. Motor coaches which are vehicles provided with a driver to a school on a single-trip or multi-trip contract basis to provide transportation to or from, or to and from, athletic or other special events. A motor coach is a vehicle at least 35 feet in length with a manufacturer's rated seating capacity of more than 30 passengers and is designed for long distance transportation of passengers, characterized by integral construction with an elevated passenger deck located over a baggage compartment. A superintendent or headmaster is required to request criminal record information for a driver of a motor coach if the driver may be in unsupervised contact with schoolchildren.

2. Multifunction school activity buses which are provided with a driver to a school on a single-trip or multi-trip contract basis to provide transportation to or from, or to and from, athletic or other special events. A superintendent or headmaster is required to request criminal record information for a driver of a multifunction school activity bus if the driver may be in unsupervised contact with schoolchildren.

In 1997, certain vans were in use to transport schoolchildren that did not conform to federal standards. With the flexibility provided for in this act for transporting schoolchildren, the approval for use of these non-conforming vans will expire on July 1, 2007. The vehicles are required to meet all Type I school bus safety and equipment standards, with a few exceptions which have otherwise been addressed.
