Municipal government; solid waste; enforcement
This act generally amends municipal law with respect to the illegal disposal of solid waste. In particular, it repeals provisions that made the municipal dumping prohibition apply only if the activity prohibited is located within 300 feet of the lands of others or the waters of the state or within view of a public highway. It incorporates a standard definition of "solid waste" to replace a list of items that were prohibited from improper disposal. It enables local enforcement of violations of burn barrel prohibitions located in the rules of the agency of natural resources. It enables environmental enforcement attorneys employed by the agency of natural resources to enforce burn barrel violations before the judicial bureau, and by means of the issuance of a ticket, and it makes it clear that the judicial bureau has jurisdiction to hear these matters. It makes the law clear that municipal enforcement does not preclude additional enforcement by the agency of natural resources, and it prohibits dual enforcement by the agency for the same offence.
