Motor vehicles; insurance; underinsured motorists
This act defines a vehicle as underinsured if: (1) the liability insurance limits applicable at the time of the accident are less than the limits of the underinsured motorist coverage applicable to the insured; or (2) the available liability insurance has been reduced by payments to others injured in the accident to an amount less than the limits of the underinsured motorist coverage applicable to the insured. When a person reasonably claims the right to recover damages from an automobile accident, the act requires the insurer to provide the person with the names of the insurer and the insured and with the limits of liability coverage. Uninsured motorist policies issued or renewed after January 1, 2006, are required to include provisions in compliance with the act.
