NO. M-17.  AN ACT RELATING TO APPROVAL OF AMENDMENT TO THE BENNINGTON SCHOOL DISTRICT CHARTER.

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  Sec. 4 of No. 213 of the Acts of 1965, as amended in Sec. 2 of No. M-16 of the Acts of 1998, is amended to read:

Sec. 4.  NEW DISTRICT TO MAINTAIN PROVIDE PUBLIC SCHOOLS

FOR GRADES KINDERGARTEN THROUGH SIXTH

(a)  After July 1, in such year, Bennington School District, Inc. shall provide for the elementary education of pupils within the territorial limits of the district for grades kindergarten through sixth.

(b)  Sixth grade.  The school board shall not allow the attendance of sixth graders of the Bennington School District at the Mount Anthony Union School District Middle School until receiving authorization from a majority of the voters of the district by Australian ballot vote at a regular or special meeting.  If authorization is given, the authorization shall remain in effect until the provisions of this charter are amended.
