ACT NO. 57


Sheriffs; Mandatory Retirement

This act removes the following employees from Group C of the Vermont State Retirement System: the Commissioner of Public Safety (however, the current Commissioner will remain in Group C), the Commissioner of Motor Vehicles, and Sheriffs. Furthermore, this act establishes certain criteria for the following employees’ eligibility in the Group C plan: motor vehicle inspectors, full-time deputy sheriffs employed by the state of Vermont, and investigators employed by the Office of the Attorney General, Department of State’s Attorneys or Office of the Secretary of State. The criteria for these employees establish that the employees: must have attained full-time certification from the Vermont criminal justice training council; must be required to perform law enforcement duties as the primary function of their employment; and may be subject to mandatory retirement permissible under 29 U.S.C. section 623(j).

This act also establishes a committee to conduct a comprehensive review of eligibility criteria for all plans of the Vermont State Retirement System.
