ACT NO. 104
Assistive Technology Device Warranties
This act follows 38 other states which have some level of warranty protection for a range of assistive technologies. The legislation sets up a lemon law for wheelchairs, scooters, and augmentative communication devices, to apply if any of them have to be repaired three times or more or are out of service for 30 or more days during the warranty period. A second portion of the bill provides consumer protections for rent-to-own agreements on all assistive technology that is rented for more than 60 days.
Effective Date: This act applies to assistive technology devices purchased by, or leased or transferred to a consumer after July 1, 2000.
