Act 250; Telecommunications Facilities; Facility Replacement
This act makes it clear that Act 250 provisions relating to preexisting development shall apply to telecommunications facilities that were in existence before July 1, 1997, the date when the act first applied to many telecommunications facilities, thus making these facilities subject to jurisdiction only upon undergoing a substantial change. The act also provides that no Act 250 permit is required for the replacement of a preexisting telecommunications facility, unless replacement would constitute a substantial change to the facility being replaced, or to ancillary improvements, or both. The act provides that no permit amendment is required for the replacement of a telecommunications facility with an Act 250 permit, unless the replacement would constitute a substantial or material change to the facility, or to ancillary improvements, or both. The act makes it clear that no permit is required for repair or routine maintenance of a telecommunications facility or ancillary improvements.
