ACT NO. 92
This act directs the Commissioner of Developmental and Mental Health Services to oversee the use of electroconvulsive therapy (ECT) and allows the commissioner to adopt rules that govern the practice of ECT. This act specifies that the duties of the commissioner include the establishment of a uniform informed consent process, forms, and materials; oversight and monitoring of all facilities administering ECT; and the collection of statistical data on the use of ECT from all treating facilities.
This act directs the commissioner to convene a committee on guardianship relating to ECT, including specified stakeholders, and to make recommendations of revisions to the current guardianship statute and rules, on or before January 1, 2001, for purposes of ensuring access to fair and adversarial processes and legal representation by knowledgeable counsel.
