Conservation; Water Milfoil; Water Chestnut; Quagga Mussel;
Water Resource Board Appointments
This act prohibits the transport of quagga mussels and water chestnuts to or from any Vermont surface water. It allows the Secretary of Natural Resources to grant exceptions to this transport ban, as well as exceptions to the transport ban that applies to zebra mussels and Eurasian water milfoil, for scientific or educational purposes. The act provides that these transportation bans, as well as the surface water rules adopted by the Water Resources Board, are enforceable by the ticket system that applies to certain violations by the operators of vessels. The act provides that with respect to the above matters, whenever a penalty for a violation of a rule is not otherwise established, a panel of three district judges appointed by the court administrator shall establish a schedule of the penalties to be imposed. Finally, the act provides that new members of the Water Resources Board shall be appointed by the Governor, subject to the advice and consent of the Senate, and that not more than one member's term shall expire in the same calendar year.
