NO. M-16. AN ACT RELATING TO THE CHARTER OF THE BENNINGTON SCHOOL DISTRICT.

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1. APPROVAL OF CHARTER AMENDMENT

The charter of the Bennington School District, Inc. is amended as provided in this act. Proposals of amendment were approved by the voters on March 3, 1998.

Sec. 2. Sec. 4 of the Charter is amended to read:

Sec. 4. New district to maintain public school for grades kindergarten through sixth

After July 1, in such year, Bennington School District, Inc. shall *[maintain all public schools]* provide for the elementary education of pupils within the territorial limits of the district for grades kindergarten through sixth *[within the territorial limits of the district]*.

Sec. 3. Sec. 9 of the Charter is amended to read:

Sec. 9. Officers of new district

(a) The officers of the Bennington School District, Inc., shall be a moderator, clerk, board of school directors*[,]* and treasurer *[and three auditors]*.

(b) The board of school directors of Bennington School District, Inc., shall have seven members who shall be elected at large. When the Bennington School District so votes at an annual or special meeting, the board of school directors may be increased or decreased by such number as is voted.

(c) All officers of Bennington School District, Inc., elected at an annual meeting shall enter upon their duties *[on July 1]* immediately following their election, and shall serve until their successors are elected and qualified*[, except that the officers elected at the first annual meeting of the district shall enter upon their duties immediately]*.

(d) The terms of office of the members of the board of school directors, moderator, clerk, and *[auditors]* treasurer shall be three years and of all other officers one year*[, except that the terms of office of the members of the school board of auditors elected at the first annual meeting of the Bennington School District, Inc., shall be as specified in section 10(b) of this act]*.

(e) The board of school directors shall annually appoint a certified public accountant toaudit the financial records of the Bennington School District, Inc.

Sec. 4. Sec. 10(c) of the Charter is amended to read:

(c) At the meeting, or an adjournment thereof, the district shall determine the compensation to be paid its officers, the date *[in June]* on which its annual meeting shall thereafter be held, shall vote a tax upon the polls and taxable estates within its territorial limits for the lawful purposes of the district, and may transact any other duly warned business pertaining to the affairs of the district.

Sec. 5. RATIFICATION

The general assembly ratifies the annual meeting of the Bennington School District held on March 3, 1998 and the actions taken at that meeting.
