Large Farm Operations

This act requires the department of agriculture, food and markets together with the department of public service to inform large farm operations of appropriate methods and resources available to digest and compost their animal wastes and to capture methane for beneficial uses. It allows the commissioner of agriculture, food and markets to act on a large farm operation application within 45 business days from receipt of a complete application. It allows the commissioner to condition or deny a permit on the basis of odor, noise, traffic, insects, flies, or other pests. It expands the commissioner's rule making power to allow rules for odor, noise, traffic, insects, flies, and other pests. It allows the commissioner to revoke a permit issued under the large farm chapter, and it allows an administrative penalty up to $5,000.00 per violation, but not to exceed $50,000.00. The act requires utilities to develop energy efficiency programs for livestock and domestic fowl farm customers.
