Petroleum Cleanup Fund; Underground Storage Tanks
This act enables enforcement, under the uniform environmental enforcement chapter, against persons who violate the underground storage tank law while installing, removing, repairing or testing an underground storage tank. It amends the law governing the petroleum cleanup fund so that disbursements from the fund may be made to cover the cost of corrective action, of up to $1 million, for any release of petroleum into the environment from a tank or tanks whose owner, in the judgment of the secretary of natural resources, is financially incapable of carrying out the corrective action in a timely manner. The act also amends the petroleum cleanup fund reimbursement language to provide that when the secretary has paid the first $10,000.00 of costs in a situation where the secretary has determined that the owner is financially incapable of carrying out the corrective action in a timely manner, the secretary may seek reimbursement of those costs.
