NO. M-8. AN ACT RELATING TO THE VILLAGE OF WATERBURY CHARTER.
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. CHARTER APPROVAL
The general assembly approves the Village of Waterbury charter amendment as provided in this act. Proposals of amendment were approved by the voters on March 11, 2003.
Sec. 2. 24 V.S.A. App. chapter 283, § 18 is amended to read:
WATER RATES BOARD
OF WATER AND SEWER
water commissioners shall establish rates to be paid for water supplied by the
village and may make such rules and regulations in regard to the use of water
as may be necessary, but such rates, rules and regulations shall not be
effective until adopted by the village. The water rates shall be and are
hereby made a lien in the nature of a tax upon the real estate so supplied by
water, and if not paid, after demand by the proper officer, shall be collected
and enforced in the same manner as other village taxes are collected and
enforced; except that the water commissioners shall make out the rate bill
therefor and such collection shall be made by the collector of water rents.
There is created a board of water and sewer commissioners consisting of
three members, each of whom shall be a resident of the village. The board
shall have the authority to supervise, manage, and operate the Village of Waterbury public
water supply system and the public sewage system.
(b) The board of water and sewer commissioners shall serve for a term of three years. Commissioners shall be elected at the annual meeting of the village. The initial board of water and sewer commissioners shall be the current members of the village board of water commissioners, who shall serve for the unexpired portion of their term.
(c) The board of water and sewer commissioners shall have the authority to establish and impose rates and charges, to adopt rules relating to the operation and protection of the water and sewer system, and to allocate water and sewage treatment capacity.
(d) The board of water and sewer commissioners shall not provide extraterritorial water or sewer services except as provided in this charter, nor shall the board authorize any capital improvement indebtedness without the approval of the legislative body of the village and approval of the Village of Waterbury when required by law.
Sec. 3. EFFECTIVE DATE
This act shall take effect upon passage.
