Subject: Conservation; petroleum cleanup fund

Statement of purpose: This bill proposes to provide that if there are insufficient funds in the petroleum cleanup fund to provide certain disbursements which otherwise would be authorized to any person for costs incurred for taking corrective action ordered by the secretary, no fines may be levied on that person for failure to take that corrective action. The bill would expire on December 31, 2002.

AN ACT RELATING TO A MORATORIUM ON CERTAIN FINES RELATED TO ACTIONS THAT OTHERWISE WOULD BE FUNDED UNDER THE PETROLEUM CLEANUP FUND

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1. PETROLEUM CLEANUP FUND; INSUFFICIENT FUNDS;

MORATORIUM ON FINES

If there are insufficient funds in the petroleum cleanup fund to provide the complete amount of disbursements which otherwise would be authorized under 10 V.S.A. 1941 to any person for costs incurred for taking any corrective action ordered by the secretary, no fines may be levied by the secretary under chapter 59 of Title 10 on that person for failure to take that corrective action, when that failure is the result of that insufficiency. This section shall expire on December 31, 2002.
