Statement of purpose: This bill proposes to adopt the crimes of criminal threatening and criminal threatening of a public official or employee.
AN ACT RELATING TO CRIMINAL THREATENING
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 13 V.S.A. § 1702 is added to read:
§ 1702. CRIMINAL THREATENING
(a) A person commits the crime of criminal threatening if the person:
(1) by physical conduct, purposely places or attempts to place another person in reasonable fear of imminent injury to the person; or
(2) threatens to commit any crime against another person with a purpose to terrorize any person; or
(3) threatens to commit any crime of violence with a purpose to cause evacuation of a building, place of assembly, facility of public transportation or otherwise to cause serious public inconvenience, or in reckless disregard of causing such fear, terror or inconvenience; or
(4) threatens to commit any crime against the property of another with a purpose to coerce or terrorize any person.
(b) If the person making the threat is incarcerated at the time of the threat, the requirement of an apparent ability to carry out the threat is not an element of the offense.
(c) A person who violates this section shall be imprisoned not more than six months or fined not more than $1,000.00, or both.
