Subject:     Mental health; involuntary treatment; minors in need of substance abuse treatment

Statement of purpose:  This bill proposes to clarify that a minor in need of inpatient drug or alcohol treatment is subject to the involuntary commitment statute.

AN ACT RELATING TO INVOLUNTARY DRUG AND ALCOHOL TREATMENT FOR MINORS

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1.  18 V.S.A. § 7101 is amended to read:

§ 7101.  DEFINITIONS

(14)  “Mental illness” means:

(A)  a substantial disorder of thought, mood, perception, orientation, or memory, any of which grossly impairs judgment, behavior, capacity to recognize reality, or ability to meet the ordinary demands of life, but shall not include mental retardation; or

(B)  for purposes of chapter 181 of this title, addiction to drugs or alcohol by a minor;
