Subject: Professions and occupations; acupuncturists; English language proficiency
Statement of purpose: This bill proposes to require the director of the office of professional regulation to administer an acupuncturist licensing examination which accommodates non-English speaking persons or to develop an alternative procedure for examination.
AN ACT RELATING TO ACUPUNCTURIST PROFICIENCY WITH THE ENGLISH LANGUAGE
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 26 V.S.A. § 3406 is amended to read:
§ 3406. EXAMINATION
(a) The director shall examine applicants for licensure and may use a standardized national examination. However, the examination shall be designed to accommodate non-English speaking applicants, or the director shall adopt rules which establish an alternative procedure for examining non-English speaking applicants. This procedure shall ensure that applicants are not denied a license solely due to their proficiency with the English language. The examination shall include the following subjects:
(1) Anatomy and physiology.
(2) Traditional Oriental pathology.
(3) Traditional Oriental diagnosis.
(4) Hygiene, sanitation, and sterilization techniques.
(5) The principles, practices, and techniques of acupuncture and Oriental medicine.
(6) Clean needle techniques.
(b) The director may adopt rules necessary to perform his or her duties under this section.
