Subject: Human services; the Vermont health access plan
Statement of purpose: This bill proposes to direct the commissioner of prevention, assistance, transition, and health access to permit an individual to enroll in the Vermont health access plan despite coverage under another health benefit plan during the prior 12 months if the cost of the prior plan is unaffordable to the individual.
AN ACT RELATING TO UNINSURED INDIVIDUALS AND THE VERMONT HEALTH ACCESS PLAN
It is hereby enacted by the General Assembly of the State of Vermont:
Sec. 1. 33 V.S.A. § 1973 is added to read:
§ 1973. THE VERMONT HEALTH ACCESS PLAN; UNINSURED
An individual may enroll in the Vermont health access plan authorized by Act No. 14 of the Acts of 1995 session if, in addition to any other eligibility requirements adopted by the commissioner by rule, the individual is uninsured. The individual shall be permitted to enroll in the Vermont health access plan despite coverage under another health benefit plan during the prior 12 months if access to health benefit plan coverage is lost due to:
(1) loss of employment;
(2) death or divorce; or
(3) the unaffordable cost of the individual’s prior plan, in accordance with rules adopted by the commissioner.
