Statement of purpose: This bill proposes to prohibit transporting animals in an open vehicle unless caged.

AN ACT RELATING TO TRANSPORTING ANIMALS IN OPEN VEHICLES

It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1. 23 V.S.A. § 1127a is added to read:

§ 1127a. TRANSPORTING ANIMALS IN OPEN VEHICLES

(a) An animal shall not be transported in a motor vehicle not enclosed on all four sides unless contained in a cage.

(b) A person who violates the provisions of this section shall be assessed a civil penalty of not more that $1,000.00.

(c) A state’s attorney may commence a criminal prosecution. A person who violates subsection (a) of this section shall be fined not more than $10,000.00 or imprisoned for not more than two years, or both.
