Subject: Municipal government; charter amendment; City of Montpelier

Statement of purpose: This bill proposes to require a vote on the total school operating budget rather than the local tax appropriation.


It is hereby enacted by the General Assembly of the State of Vermont:


The charter of the City of Montpelier is amended as provided in this act.

Proposals of amendment were approved by the voters on March 4, 1997.

Sec. 2. Title VI, Section 13 of the Charter is amended to read:

Title VI, Section 13 School Fund: The City Council shall annually appropriate such dollar amount *[as]* necessary for support of the school budget as may be voted *[for the support of the schools]* at the annual city meeting or any special meeting duly warned and held for that purpose, all such moneys as shall be received from the state for the use of schools, all moneys and income from tuition and any other sources for the use of schools,and the income of any other property or money donated by any person to the city for the use of schools, all money as may be received from the federal government for the use of schools and money received from any source and specifically designated as money to be used for schools, the total amount of which shall be kept by the city treasurer, unless especially exempted by the city council, and the city council shall authorize warrants drawn on the city treasury for the payment of the same to the treasurer of the board of school commissioners, upon requisition made by such board, at such times and for such amount, not exceeding in the total for the year the amount of the school fund, as such requisition shall designate.

Sec. 3. Title V, Section 8 of the Charter is amended to read:

Title V, Section 8 Method of Voting Appropriation: The tax appropriation consisting of *[three]* two separate items of *[schools,]* general fund and recreation, which shall be voted upon separately by separate ballot, during regular voting hours.

Sec. 4. Title V, Section 14 of the Charter is added to read:

Title V, Section 14 School Budget: The school budget shall be voted by separate ballot during regular voting hours.


This act shall take effect from passage.
