Subject: Motor vehicles; operating of vehicles; DUI; highway; private driveway

Statement of purpose: This bill proposes to eliminate private driveways from the definition of highway in DUI cases.


It is hereby enacted by the General Assembly of the State of Vermont:

Sec. 1. 23 V.S.A. § 1201(d) is added to read:

(d) A driveway and other private lands appurtenant to a privately owned single or multi-unit residence shall not be considered a highway for the purposes of this section.
